HUMAN RIGHTS MATTERS WE HANDLE

Ontario's Human Rights Code prohibits discrimination based on protected grounds in areas such as employment, housing, services, contracts, and membership in certain vocational associations.

We assist with matters involving:

Not every instance of unfair treatment constitutes a violation of the Human Rights Code. The circumstances must establish a connection to a protected ground or another prohibited practice within the Tribunal's jurisdiction.

HOUSING DISCRIMINATION & TENANT RIGHTS

Landlords and housing providers must comply with Ontario's Human Rights Code.

Discrimination may arise when a landlord:

• Refuses to rent because of a protected characteristic.
• Harasses a tenant based on disability, race, religion, family status, or another protected ground.
• Fails to reasonably accommodate disability-related needs.
• Imposes discriminatory rental conditions.
• Treats tenants differently because of a protected characteristic.
• Retaliates against a tenant for asserting rights protected by the Code.

REMEDIES AVAILABLE THROUGH THE HRTO

Where the Tribunal finds that the Human Rights Code has been violated, it may order remedies such as:

Compensation for injury to dignity, feelings, and self-respect.

• Compensation for proven financial losses resulting from discrimination.
• Non-monetary remedies addressing discriminatory conduct.
• Workplace or housing accommodation measures.
• Changes to discriminatory policies or practices.
• Public interest remedies intended to promote future compliance with the Code.

The availability and amount of compensation depend on the circumstances, supporting evidence, and applicable law.

IMPORTANT: HUMAN RIGHTS FILING DEADLINES

Applications to the Human Rights Tribunal of Ontario generally must be filed within one year of the alleged discriminatory incident, or within one year of the last incident in a series of related incidents.

The Tribunal may permit a late application in limited circumstances where the statutory requirements are met.
